TRANSFORMING PERCEPTIONS: HOW SENSITIZATION TRAINING FOSTERS A MORE INCLUSIVE JUDICIARY IN KENYA

The data is based on a survey conducted in 2022 with 53 judges and magistrates who participated in a training program organised by INEND, a Kenyan organisation dedicated to serving the sexual and gender minority (SGM) community.
The results offer a glimpse of hope for a more inclusive justice system. Over 70% of judicial officers surveyed after the training acknowledged that existing laws, like Sections 162, 163, and 165 of the Penal Code which criminalise same-sex intimacy, negatively influence societal views of LGBTQ+ people.
This shift in perspective is significant, considering that more than half the judicial officers initially believed the justice system treated everyone equally.
The training’s impact goes beyond legal understanding. After attending, nearly 80% of judicial officers indicated they would either be comfortable or indifferent to living next door to someone who identifies as LGBTQ+.
This newfound empathy is echoed in a powerful quote from a judicial officer who participated in the training: “LGBTQ+ people are unable to access basic rights like the right to healthcare, and even justice amongst other rights.” This statement highlights the critical need for a justice system that upholds the dignity of all, regardless of sexual orientation or gender identity.
INEND’s work demonstrates that perceptions can change with the right approach. Sensitization training that fosters understanding and empathy paves the way for a fairer and more inclusive legal system in Kenya.
